A service mark is any word, name, symbol, device, or any combination, used, or intended to be used, in commerce, to identify and distinguish the services of one provider from services provided by others.

 


Sellers of goods throughout the ages have put their names on things they produced. Some producers devised symbols or pictures to identify and distinguish their products. Before the 20th century, trademarks were usually symbols or pictures rather than words. Under the common law in each state, a seller who uses any symbol as a trademark acquires the legal right to prevent other sellers from using a similar mark. Many sellers federally register their trademarks for extra protection.

Congress provided a nationwide register of trademarks for sellers who participate in interstate commerce with the federal Lanham Act, enacted in 1946. Definition:
A rule under which patent priority, and thus entitlement to a patent, is determined by which inventor was the first to file a patent application, rather than who was first to actually invent.

Supplemental Register

Definition:
Secondary trademark register for the USPTO. It allows for registration of certain marks that are not eligible for registration on the Principal Register, but are capable of distinguishing an applicant’s goods or services.

Musical Work

Definition:
A category of copyrightable work expressed in notation or sounds.
